Repairs & Servicing Terms and Conditions
1. Scope of Services
These Repairs & Servicing Terms apply to all repair, servicing, maintenance, diagnostic and related services (“Services”) provided by TMEC UK Limited, trading as Packsealer (“we”, “us”, “our”) to customers acting in the course of business (“Business Customers”).
By instructing us to carry out Services, you confirm that you are acting for business purposes and not as a consumer.
2. Estimates and Authorisation
Any estimates or quotations provided are estimates only unless expressly stated otherwise in writing.
Repairs often require inspection or disassembly, and additional faults or necessary work may become apparent once work has commenced. We will not proceed with additional chargeable work without your authorisation, except where necessary to make equipment safe or prevent further damage.
We reserve the right to decline or cease work where a repair is uneconomic or impractical.
3. No Guarantee of Economic Repair
You acknowledge that:
- Older or heavily used machinery may suffer from multiple or latent faults
- A repair may not restore equipment to “as new” condition
- The cost of repair may exceed the replacement value of the equipment
We do not guarantee that the equipment is economically repairable.
4. Parts and Materials
We may use:
- New parts
- Reconditioned parts
- Equivalent or compatible components
Part availability is subject to supplier availability. Where original manufacturer parts are unavailable, suitable alternatives may be used.
5. Pre-Existing Faults and Limitations
We are not responsible for:
- Pre-existing faults or wear
- Failures unrelated to the specific repair carried out
- Damage caused by misuse, incorrect operation, inadequate maintenance, or unsuitable operating conditions
Machinery may fail in other areas following repair due to age, wear or prior condition.
6. Warranty on Repairs
We provide a limited warranty on workmanship only for a period of 90 days from completion of the Services. Third-party parts fitted during a repair carry the manufacturer's own warranty terms.
This warranty:
- Covers defects in workmanship directly attributable to the Services performed
- not cover parts unless expressly stated
- Excludes normal wear and tear, misuse, operator error, and subsequent faults
Our obligation under this warranty is limited to re-performing the relevant Services.
7. Customer Responsibilities
The customer is responsible for:
- Providing accurate information about the equipment and fault
- Ensuring safe, clear and suitable access for site-based Services
- Ensuring machinery is isolated, clean, and safe to work on
- Compliance with health and safety requirements at the site
We reserve the right to suspend Services if conditions are unsafe.
8. Carriage, Travel and Risk
Unless agreed otherwise in writing:
- The customer is responsible for all inbound and outbound carriage of equipment
- The customer bears the risk of loss or damage in transit
- Travel time, mileage, accommodation and subsistence may be chargeable for site visits
9. Abandoned Equipment
Where equipment is not collected or instructions are not provided within 30 days of notification that work is complete (or uneconomic), we reserve the right to:
- Charge reasonable storage fees; and/or
- Dispose of or sell the equipment after giving reasonable notice, applying proceeds against outstanding charges.
10. Payment Terms
Invoices for Services are payable in accordance with the terms stated on the invoice.
We reserve the right to withhold release of equipment until payment is received in full.
11. Limitation of Liability
Our total liability in respect of Services shall be limited to the amount paid for the Services giving rise to the claim.
We shall not be liable for:
- Loss of profit
- Loss of production
- Downtime
- Loss of contracts or business
- Any indirect or consequential loss
Nothing in these Terms limits liability for death or personal injury caused by negligence.
12. Relationship to Sales Terms
These Repairs & Servicing Terms apply separately from our product sales Terms and Conditions and do not extend or replace any product warranty unless expressly agreed in writing.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
